藏超額現鈔出國 老翁被沒收十萬港幣

劉姓退休老翁，去年1月底要搭機去澳門，被航警局安檢人員查獲攜帶超額港幣18萬5000元，清點後沒收10萬7000元。劉提行政訴訟主張，他不知帶現鈔出國有限額，被查獲的錢中有他的老人年金、付國外律師的律師費，他沒有前科，不是故意要犯罪，請求退還10萬港幣。

台北高等行政法院指出，劉並非主動報繳，是被安檢人員搜出現金後才承認，違法事實已經成立，他沒有前科，跟攜帶超額現鈔出境無關，今天判決海關依法沒收十萬港幣無誤，駁回劉的訴訟。
