超車持球棒毆人不道歉　檢方硬要他坐牢

台中市1名黃姓男子因超車糾紛，持球棒打破對方車窗且毆人，不道歉且未有悔意，法官雖判他可易科罰金，但檢方以行為惡劣要他入監服刑。

今日出版的《聯合報》報導，黃男前年開車發生超車糾紛，他趁在對方停等紅燈時，持球棒打破對方車窗且打傷人。法院依傷害與毀損罪，分別判刑6個月和拘役40日，易科罰金是1000元折算一日。

黃男上月18日到台中地檢署報到執行，向檢察官聲請易科罰金遭拒，要他入監服刑；他在獄中向法院聲明異議，因是家中獨子，有老母親需照顧等理由，盼法官能讓他可繳罰金，仍被法院駁回。（陳亮諭／綜合報導）
